Schwarzenegger Cuts Sentence for Politician's Son

Just before leaving office, Governor Schwarzenegger commuted the sentence for a Politican's son. Esteban Nunez' voluntary manslaugher sentence was reduced from 16 years to 7 years. It is interesting to note that Nunez took a plea of voluntary manslaughter in order to avoid having to go to trial on a murder charge, which carries a maximum penalty of life. Governor Schwarzenegger stated that the sentence was excessive because Nunez was serving the same sentence as the co-defendant who was found to inflict the wound that killed the victim. Although this may or may not have been the right decision, the timing of the former governor's actions are suspect. Various articles even stated that the vicitim's family was not given any notice of the former governor's actions. The family actually discovered the reduced sentence from reporters. Whether the former governor's action was reasonable or not, he should have acted with more sympathy and respect towards the victim's family.

Due to numerous unknown facts surrounding a case, it is difficult to comment on a plea that a defendant accepts or rejects on the advice of his/her attorney. It is important that a criminal defendant retains a criminal attorney he/she has open communication with and can trust.
