The "Soul Collector"

Check out this news article. A man allegedly went into someone's garage and said he was a "soul collector." The "soul collector" attempted to cut of the man's toes, slit his throat, scalp him and stab him in the chest, while saying that he needed to "collect his soul." He was charged with attempted murder.

Although the details of the case are unknown, it appears that a plea of not guilty by reason of insanity is forthcoming. In California, Penal Code Section 25(b) states:

"In any criminal proceeding, including juvenile court proceeding, in which a plea of not guilty by reason of insanity is entered, this defense shall be found by the trier of fact only when the accused person proves by a preponderance of the evidence that he or she was incapable of knowing or understanding the nature and quality of his or her act and of distinguishing right from wrong at the time of the commission of the offense."
